Terms and Conditions
§ 1 Scope and provider
These Terms apply to paid services between Ursula Pichler, Avenida Litoral de Agache 38, 38591 La Puente, Tenerife, Spain (NIF Z1137839B; email passing.on.light@gmail.com) (the "Provider") and her clients. A consumer is any natural person concluding the contract predominantly for private purposes. Services are aimed at clients in Spain, Germany and the rest of the EU.
Governing law: These Terms and the contracts concluded under them are governed — including for digital and distance services — by Spanish law (Provider established in Spain; in particular Ley 34/2002 [LSSI-CE], Real Decreto Legislativo 1/2007 [consumer protection] and Ley 7/1998 [general terms]). For consumers habitually resident in another EU state (e.g. Germany), their mandatory consumer-protection provisions additionally apply (Art. 6 Rome I; see § 10).
§ 2 Services / No promise of cure
The subject matter is Reiki sessions (in person on Tenerife and as distance/online sessions), meditation offerings, a paid meditation membership and gift vouchers. Reiki and meditation serve relaxation and wellbeing only. They are not medical or therapeutic treatment, do not replace medical diagnosis or therapy and contain no promise of cure. For health concerns, please seek medical or therapeutic advice. Advertising statements are governed by Spanish law (in particular RD 1907/1996, Ley 34/1988, Ley 3/1991); for consumers from Germany the HWG additionally applies.
§ 3 Conclusion of contract
The presentation of offers is not a binding offer. By booking (online, by email or in person) the client makes a binding offer; the contract is concluded upon confirmation by the Provider.
§ 4 Prices and payment
The prices stated at the time of booking apply as final prices. The Provider is established in the Canary Islands and is subject to the local IGIC regime; no value-added tax (IVA/VAT) is shown. Reiki sessions and single services are paid in person. The meditation membership is billed monthly in advance.
§ 5 Meditation membership
The membership is concluded for an indefinite period and billed monthly; there is no minimum term. It may be cancelled by either party at any time without notice to the end of the current billing period (month); the right to extraordinary termination for good cause (Art. 1124 Código Civil) remains unaffected. Cancellation requires text form (e.g. email). For consumers resident in Germany who concluded the contract online, a cancellation button is additionally provided on the website ("Cancel contracts here", § 312k BGB as a mandatory protective provision under Art. 6 Rome I). The Provider confirms receipt and the end date in text form. Access remains until the end of the paid period; no pro-rata refund of the current month is given.
§ 6 Gift vouchers
Vouchers are valid for 12 months from the date of issue, cannot be paid out in cash and can only be redeemed for the Provider's own services. Any remaining balance stays usable until expiry.
§ 7 Right of withdrawal for consumers (distance contracts)
For contracts concluded at a distance (online/by phone), consumers have a statutory right of withdrawal (derecho de desistimiento, Art. 102 RDL 1/2007; harmonised EU-wide, in Germany § 355 BGB).
Withdrawal instructions: You have the right to withdraw from this contract within fourteen days without giving any reason. The period is fourteen days from conclusion of the contract. To exercise it, inform us (Ursula Pichler, address and email see § 1) by a clear statement (e.g. by email). You may use the model withdrawal form below, but this is not mandatory.
Consequences: In the event of a valid withdrawal we refund all payments received without undue delay and at the latest within fourteen days of receipt of the notice, using the same means of payment.
Early expiry / compensation: If you expressly requested that the service begin during the withdrawal period, you must pay a reasonable amount for the service rendered up to the withdrawal. The right of withdrawal expires once the service has been fully performed and you expressly agreed beforehand and acknowledged losing the right upon full performance. For digital content (membership), the right of withdrawal expires if you expressly consent to immediate access and acknowledge the loss of the right.
§ 8 Appointments, cancellation and no-show
Agreed appointments may be rescheduled or cancelled free of charge up to 24 hours beforehand. For cancellation later than 24 hours before the appointment or for a no-show, a cancellation fee of 50 % of the agreed price may be charged; saved expenses are credited and the client may prove that less or no loss was incurred. If the Provider has to cancel, amounts already paid are refunded or an alternative appointment is offered.
§ 9 Liability
The Provider is liable without limitation for intent and gross negligence and for injury to life, body or health. For ordinary negligence she is liable only for breach of an essential contractual obligation and limited to the foreseeable damage typical of the contract. Otherwise liability is excluded.
§ 10 Applicable law and consumer protection
Spanish law applies, excluding the UN Convention on Contracts for the International Sale of Goods — including for digital and distance services (country-of-origin principle). For consumers, the mandatory consumer-protection provisions of their state of habitual residence (e.g. Germany) remain unaffected (Art. 6 Rome I).
§ 11 Dispute resolution
The European Commission's ODR platform was discontinued on 20 July 2025. In Spain, the Sistema Arbitral de Consumo is available; there is no obligation to participate.
§ 12 Final provisions
Should any provision be invalid, the validity of the remaining provisions is unaffected. The contract and communication languages are German, English and Spanish.
